Welcome to Recruiting from Scratch ("RFS," "we," "us," or "our"). By accessing or using our website at recruitingfromscratch.com, our careers portal, or any related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions. 2. Our Services
RFS is a recruiting and staffing firm. We connect employers with qualified candidates through job listings, candidate sourcing, screening, and matching services. Our platform supports direct-hire placements, contract staffing, and recruiting partnerships.
3. Your Use of Services
To use our Services, you must be at least 18 years of age, provide accurate information, keep your account credentials secure, and use the Services only for lawful purposes related to employment and recruiting. We reserve the right to suspend or terminate access for any user who violates these terms.
4. For Employers
When you engage RFS to fill positions or access candidate information, candidate profiles, resumes, and personal data shared with you are confidential. You may use them only for evaluating candidates for the specific role(s) discussed with RFS. You are responsible for handling candidate data in compliance with applicable privacy laws. Fee schedules and placement terms are governed by your separate service agreement with RFS.
5. For Candidates
By submitting your resume, application, or personal information through our Services, you consent to RFS collecting, storing, and processing your information for recruiting purposes. You understand your profile may be shared with prospective employers for roles that match your qualifications. You may request to view, update, or delete your information at any time by contacting us. Submitting an application does not guarantee placement or employment.
6. AI-Assisted Screening Disclosure
RFS uses artificial intelligence tools to assist in the screening and matching process, including automated resume parsing and skills extraction, AI-assisted candidate-job matching and scoring, and AI-powered phone screening conversations.
Human oversight: AI recommendations are used as one input in our process. A human recruiter reviews all candidate evaluations before any hiring decision is made or communicated to employers.
Your rights: You may request human review of any AI-assisted assessment by contacting us at info@recruitingfromscratch.com or (646) 495-3025. We will accommodate such requests promptly. We conduct regular bias audits of our AI screening tools to ensure fair and equitable outcomes.
This disclosure is provided in compliance with New York City Local Law 144 and the Illinois Artificial Intelligence Video Interview Act, where applicable.
7. Your Data Rights
You have rights regarding the personal information we collect: Access (request a copy of the data we hold about you), Correction (ask us to update inaccurate information), Deletion (request that we delete your personal data, subject to legal retention requirements), and Opt-out of sale (we do not sell personal information).
For California residents, these rights are provided under the CCPA. For EU/UK residents, your rights under the GDPR also apply. We retain candidate data for a reasonable period after your last interaction with us, or until you request deletion. 8. SMS and Call Communications
By providing your phone number, you consent to receive calls and text messages from RFS related to job opportunities, scheduling, and recruiting updates. Message frequency varies. Reply STOP to opt out. Your consent is not a condition of using our Services. Standard message and data rates may apply.
9. Intellectual Property
All content on our website and platform is the property of RFS or our licensors and is protected by copyright and trademark law. Content you submit remains yours. By submitting it, you grant RFS a non-exclusive license to use it for recruiting purposes.
10. Prohibited Activities
You agree not to provide false or misleading information, scrape or harvest data from our platform, attempt unauthorized access to our systems, use our Services to discriminate, interfere with the operation of our Services, or resell candidate or employer data.
11. Cookies and Analytics
Our website uses cookies and similar technologies. We use PostHog for product analytics and Google Analytics (GA4) for website traffic patterns. You can manage cookie preferences through your browser settings.
12. Third-Party Links
Our Services may contain links to third-party websites. We are not responsible for the content or privacy practices of external sites.
13. Limitation of Liability
To the fullest extent permitted by law, RFS's total liability for any claims arising from your use of our Services is limited to the fees you paid to RFS in the twelve months preceding the claim, or $100, whichever is greater. We are not liable for indirect, incidental, or consequential damages. We provide our Services on an "as-is" basis without warranties of any kind.
14. Governing Law and Dispute Resolution
These terms are governed by the laws of the State of New York. Any disputes will be resolved through binding arbitration administered by the American Arbitration Association in New York, NY. You agree to waive any right to participate in a class action.
15. Changes to Terms
We may update these terms from time to time. When we make material changes, we will notify you by email or by posting a notice on our website. Your continued use constitutes acceptance of the updated terms.
